INDEPENDENT CONTRACTOR LAW 

On Thursday May 29, 2008, ABC, in conjunction with the Attorney General's office held a sold out seminar on the Independent Contractor law for ABC members and invited guests at the Newton Sheraton. Kevin Conroy, Business and Labor Bureau Chief, and Joanne Goldstein, Division Chief, Fair Labor Division, represented the Attorney General’s Office. The purpose of the Independent Contractor (IC) law forum was to educate members about the Attorney General’s new advisory and enforcement policies, as well as to answer questions of attendees pertaining to the law. ABC has worked with the Attorney General's office, along with our industry allies, to help foster greater clarity on the law to accompany active enforcement. The IC law is an issue that ABC takes seriously, as evidenced by Board of Director’s position in the next column.

The ABC MA Board of Directors reaffirms ABC's position that all contractors take specific steps to insure they are in compliance with the state's Independent Contractor law, including properly classifying employees and withholding taxes and other deductions, such as workers' compensation, as appropriate. Contractors should also ensure that any subcontractors they hire are legitimate, independently-established businesses that comply with the Independent Contractor law. ABC supports the efforts of the Attorney General to provide clarity and guidance on the law along with strong and fair enforcement
